Reseña del libro de Karl-Otto Apel: Paradigmas de Filosofía Primera, Andrés Crelier y Miguel Mailluquet (Trad.), Buenos Aires, Prometeo, 2013.

En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). This paper proposes freedom as the condition of possibility for the construction of trust in human relationships. The methodology used is a review of the scientific literature of the most recent moral and political philosophy. As a result of the dialogue between different positions, it is discovered that freedom, despite being present in the act of trust, is forgotten in the discussion around trust, a forgetfulness that has as its main causes the assumption that trust is natural and the confusion (...) between the propensity to trust and the act of trusting. All this leads to proposing an approach of the act of trusting that starts from the freedom of the trustee and the trustor. (shrink)

La prevención en materia ambiental, como concepto y principio, es una opción eficaz para aplicar el principio ético de responsabilidad esbozado por Hans Jonas, que propugna por un tratamiento responsable del ambiente de cara a su preservación para las generaciones venideras. En este sentido, la prevención es también un mecanismo de gestión que le da a cada riesgo ambiental el tratamiento particular que se merece, dadas sus características, premura e incluso potencial impacto en lo social, económico y ambiental. Esta obra (...) es una apuesta por un debate multidisciplinar sobre algunos de los temas vigentes de la gestión del riesgo ambiental, desde la incertidumbre y el análisis económico, hasta la reparación del mismo como un mecanismo disuasivo en la óptica de la responsabilidad civil. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)

Esta investigación pone en diálogo las posiciones de Hobbes y de Spaemann respecto a la naturaleza de la confianza, para lo cual se asume una postura hermenéutica. Los principales resultados de esta arrojan que para Hobbes la confianza ha de ser aprendida, pues la desconfianza es lo primero con lo que se encuentra el ser humano; mientras que, para Spaemann, el hombre es un ser confiado y aprende a desconfiar. Como efecto de este diálogo se descubre que ambos autores tienen (...) como base para la confianza la sociabilidad humana, por lo cual se concluye que la disposición de la confianza se da en la naturaleza humana como condición de posibilidad para el acto de confiar. Este paper examina en detalle el marco constitucional dispuesto en 1991 para la protección del medio ambiente y la configuración del Estado colombiano frente a los nuevos retos que plantea la protección ambiental. Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En tal sentido, lo que se pretende evidenciar es la existencia de un panorama de (...) constitucionalización de los derechos ambientales con signicativos avances tales como el rol preponderante que ha adquirido el principio de precaución o el reconocimiento de la función ecológica de la propiedad. Aunque la problemática de los daños ambientales ha atraído el interés sustancial de profesionales y académicos de diversas disciplinas, los motivos que impulsan esas prácticas han recibido poca atención en la literatura jurídica colombiana. Especialmente desde la perspectiva de la responsabilidad. Este capítulo presenta unas reflexiones preliminares de la responsabilidad por daños ambientales, para introducir el estudio de diversos temas, hacia una construcción doctrinal enmarcada no sólo en el deber de evitar el progresivo deterioro ambiental causado por el hombre, sino (...) para salvaguardar las especies vivas que habitan y habitarán este planeta, así como el legado que le quedará a las generaciones venideras. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. We show the simulation of the suggested regulator in two electricity generators. (shrink)

El objetivo de este trabajo será responder si las potestades de la DGA son idóneas para paliar los efectos de la sequía, a través de tres secciones: primera, Identificación de la sequía como fenómeno fáctico multifactorial y su tratamiento en el CAg; segunda, revisión de las potestades de la DGA de acuerdo al artículo 314 CAg; tercera, revisión de la normativa que incorpora el usos prioritario del aguas y derecho humano al agua, cuya metodología será principalmente descriptiva, a través del (...) método dogmático basado en la legislación y la doctrina, igualmente el método exegético para establecer el sentido de conceptos técnicos. The subject of this study, the step forward—which the author felt to be ‘of evolutionary value’—was occasioned by a Delphi discussion. The debate was opened by Varga's (2003, 2006a) contrastive exposition of diagnoses of present history with respect to Hungary's accession to the European Union, offered by some leading Hungarian sociologists (Henrik Kreutz, Kálmán Kulcsár, Iván Szelényi, Iván Vitányi), in which he tried to place the views of these authors in a value sociological system by Charles Morris (1956, (...) 1964) and Geert Hofstede (1991). In Morris’ case, this involved recourse to his combination of two systems: one semiotic, the other axiological; in Hofstede's, to his system of ‘software of the mind’ embracing axiology and organizational psychology. This synthesis was opposed by Kreutz (2006a) who offered a new ordering principle which he advanced as truer to life. The present confrontation between the value sociological synthesis advanced by Kreutz, on the one hand, and the trends hallmarked by the names of Morris and Hofstede, on the other hand, provided the author with an opportunity to find a resolution of the tension between desired and desirable, for which he has gained some side light from Robert K. Merton's (1957) theory of the different degrees of insulation of role–activities from observability by members of the role–set (and which has derived further refinement from Jean–Paul Sartre's conception of ‘glance and shame’). Due to the difficulty in solving combinatorial optimization problems, it is necessary to improve the performance of the algorithms by improving techniques to deal with complex optimizations. This research addresses the metaheuristics of marriage in honey-bees optimization based on the behavior of bees. The current study proposes a technique for solving combinatorial optimization problems within proper computation times. The purpose of this study focuses on the travelling salesperson problem and the application of chaotic methods in important sections of the MBO (...) metaheuristic. Three experiments were conducted to measure the efficiency and quality of the solutions: MBO with chaos to generate initial solutions ; MBO with chaos in the workers ; and MBO with chaos to generate initial solutions and the workers. The application of chaotic functions in MBO was significantly better at solving the travelling salesperson problem. (shrink)

Si hubiera que resumir la vida de Mauricio Uribe López, habría que decir que, en términos personales, fue un ser humano cálido y generoso; en términos profesionales, un profesor admirado; y en términos filosóficos, un liberal igualitario, un socialdemócrata de la tradición de John Rawls y Amartya Sen convencido de que aportar buenos argumentos al debate público es un deber cívico. Sus trabajos en el campo de la ciencia política se centraron en la construcción de paz, el conflicto armado (...) colombiano, las guerras civiles, el desarrollo humano, las desigualdades y las instituciones, algunos de ellos con mayor contenido teórico político y otros que revelaban su formación como economista de la Universidad Nacional de Colombia. La construcción de un Estado fuerte y legítimo que contribuyera a morigerar las desigualdades sociales y económicas fue una de sus obsesiones. (shrink)

“El Pasado Entrometido: La memoria histórica como campo de batalla” del profesor Iván Garzón Vallejo (Crítica, 2022), es una invitación a explorar el carácter esencialmente trágico de las transiciones (a la democracia o de la guerra a la paz) en la que se expresan dilemas políticos centrales: reconciliación versos justicia; olvido versus memoria; política versus derecho; convivencia versus derechos humanos y, futuro versus pasado. Las sociedades, como las personas, atraviesan de forma no necesariamente secuencial, diferentes etapas del duelo: negación, (...) ira, depresión, aceptación y negociación. Garzón Vallejo recalca la importancia de evitar el maniqueísmo para afrontar los claroscuros y las complejidades de las guerras. Cuestiona, además, la noción presente en el aforismo “quienes no pueden recordar su pasado están condenados a repetirlo” en la medida en que ni el pasado se repite siempre igual ni el recuerdo nos inmuniza frente al horror. In this context, it is quite remarkable that a conference on Hispanic philosophy in the age of discovery should have been convened to examine the philosophical figures and treatises of the era. As it turns out, this volume represents probably one of the most enduring outcomes of the myriad activities of 1992. This is a volume that ranges widely into the philosophical world of the period, brings to light the richness and significance of philosophers and their work, and provides a coherent and consistently well-researched set of essays.The volume consists of fifteen essays divided into five parts. Part I consists of one essay by Jorge J. E. Gracia which offers a wide panorama of Hispanic philosophy from 1500 to 1650, as well as a lucid interpretation of the historical reasons why Hispanic philosophy seems to have reached a dead end in the context of modern European philosophy, and suffered the neglect of intervening centuries. Part II consists of one essay by Mauricio Beuchot on discussions concerning the conquest of Mexico; two essays by John Doyle and Marcelo Sánchez-Sorondo on the work of Francisco de Vitoria; and two essays on the celebrated dispute between Juan Ginés de Sepúlveda and Bartolomé de las Casas in 1550–51, the first by Eduardo Andújar and the second by Rafael Alvira and Alfredo Cruz. Part III includes essays by William Wallace on Domingo de Soto and Galileo’s science; Juan Antonio Widow on the economic thought of the Spanish Scholastics; Jean de Groot on the mysticism of Teresa de Avila; Yves Floucat on St. John of the Cross, and Mirko Skarica on the problem of future contingents. Part IV includes three essays by Norman Wells, Stephen Menn, and Carlos G. Noreña on the works of Francisco Suárez, probably the best-known Spanish thinker of the period. The volume closes with Part V, which has a long essay by John Deely on John Poinsot’s doctrine of signs.A volume of this scope and nature is bound to contain some overlap and repetition, as is the case with the pieces concerning the Las Casas-Sepúlveda debate. And yet these essays read well because the authors seriously undermine the conventional treatment of Sepúlveda as the hawkish defender of Indian slavery, and place him in the context of a larger Renaissance view of non-European peoples. Las Casas, in the view of the authors, had a great deal more in common with his opponent than the historiography has thus far suggested. In other sections of the volume, the variety of approaches and subjects on the part of the contributors challenges the reader to constantly shift grounds. Part III, for instance, takes us from the disquisitions on the velocity of falling bodies to the moral aspects of economic thought, and to the meaning of mystical theology. Fortunately, the competence of the researchers makes all individual pieces worthwhile even if this particular reviewer would have been somewhat more stringent with the space allotted to make a point.Contributors to this book leave no doubt as to the importance of their subjects, and yet they resist the temptation of exaggerating the extent of the influence of many of the Spanish authors on other European thinkers. I argue against theories that attempt to reduce scientific representation to similarity or isomorphism. These reductive theories aim to radically naturalize the notion of representation, since they treat scientist's purposes and intentions as non-essential to representation. I distinguish between the means and the constituents of representation, and I argue that similarity and isomorphism are common but not universal means of representation. I then present four other arguments to show that similarity and isomorphism are not the constituents of scientific representation. I (...) finish by looking at the prospects for weakened versions of these theories, and I argue that only those that abandon the aim to radically naturalize scientific representation are likely to be successful. This paper defends an inferential conception of scientific representation. It approaches the notion of representation in a deflationary spirit, and minimally characterizes the concept as it appears in science by means of two necessary conditions: its essential directionality and its capacity to allow surrogate reasoning and inference. The conception is defended by showing that it successfully meets the objections that make its competitors, such as isomorphism and similarity, untenable. In addition the inferential conception captures the objectivity of the cognitive representations (...) used by science, it sheds light on their truth and completeness, and it explains the source of the analogy between scientific and artistic modes of representation. In this essay, I reflect on the implications of intellectual virtues in scientific endeavor. To this end, I first offer a depiction of scientific endeavor by resorting to the notion of academic attitude, which involves aspects concerning the generation and possession of knowledge. Although there are differences between these activities, they have in common the engagement of diverse intellectual agents (scientists). In this sense, I analyze how intellectual virtues are linked to 1) scientific research tasks, such as theory appraisal, and (...) 2) those tasks of vigilance and intervention in the uses of scientific knowledge. I conclude that intellectual virtues play a leading role in achieving higher quality scientific research and adequate foresight on the uses and impacts of scientific findings. In this order of ideas, I propose an agenda for further inquiries on these matters, highlighting the relevance of reflecting and empirically researching the relationship between intellectual virtues and science, as well as cultivating intellectual virtues in various stages of scientific training. Scientific representation is a currently booming topic, both in analytical philosophy and in history and philosophy of science. The analytical inquiry attempts to come to terms with the relation between theory and world; while historians and philosophers of science aim to develop an account of the practice of model building in the sciences. This article provides a review of recent work within both traditions, and ultimately argues for a practice-based account of the means employed by scientists to effectively achieve representation (...) in the modelling sciences. This chapter looks at the history of US citizenship and immigration law and argues that denying admission or citizenship status to certain groups of people is closely correlated to a denial of whiteness. On this account whiteness is not a fixed or natural concept, but instead is a social construction whose composition changes throughout time and place. Understanding whiteness in this way allows one to see how white supremacy is not limited merely to instances of racism or ethnocentrism, but can (...) also include instances of xenophobia. On this account, whiteness is more analogous to a braid of three interwoven strands: the racial strand (e.g., science, biology, or phenotypes), the ethnic strand (e.g., culture, customs, or heritage), and the national strand (e.g., territory, sovereignty, and citizenship). In emphasizing one or a combination of these strands, whiteness can be granted to social groups that previously were denied full white status, while at the same time it can be rescinded from groups that at different times and different places might have been considered (if only provisionally) white. Understanding whiteness in this way is important for dealing with issues of immigration and citizenship because it lets us see how nationality and xenophobia play a role in the construction of whiteness and thereby how terms like illegal help to reify the status of certain persons, including natural born citizens, as perpetual foreigners (i.e., non-whites). Este artículo plantea el inicio, desarrollo y evolución de la lucha por las libertades en el CSIC, incardinándola en el proceso que tuvo lugar en toda España y con el que lógicamente, coincide en sus líneas generales. El hecho de que la situación en el CSIC no tuviera la repercusión social de la que tenía lugar en otros Centros homologables —la Universidad, por ejemplo— responde a situaciones específicas del Consejo, analizadas por la autora. El trabajo se centra en la situación (...) madrileña, perspectiva explicable por la similitud del proceso a nivel general, por el peso de los Centros madrileños en el Organigrama nacional del CSIC y por la observación participante de la autora que desearía que pronto se multipliquen análisis de este tipo referidos a otras autonomías resaltando sus indiscutibles especificidades. This essay argues that we should find Crimmigration, which is the collapsing of immigration law with criminal law, morally problematic for three reasons. First, it denies those who are facing criminal penalties important constitutional protections. Second, it doubly punishes those who have already served their criminal sentence with an added punishment that should be considered cruel and unusual (i.e., indefinite imprisonment or exile). Third, when the tactics aimed at protecting and serving local communities get usurped by the federal government for (...) immigration enforcement purposes, they often undermine these original aims or get used in ways that conflict with the U.S. Constitution. These concerns should prompt us therefore either to reject the government’s plenary power over immigration or require the federal government to be more consistent about maintaining the separation between criminal law and immigration law. This paper reviews four attempts throughout the history of quantum mechanics to explicitly employ dispositional notions in order to solve the quantum paradoxes, namely: Margenau's latencies, Heisenberg's potentialities, Maxwell's propensitons, and the recent selective propensities interpretation of quantum mechanics. Difficulties and challenges are raised for all of them, and it is concluded that the selective propensities approach nicely encompasses the virtues of its predecessors. Finally, some strategies are discussed for reading similar dispositional notions into two other well-known interpretations of quantum (...) mechanics, namely the GRW interpretation and Bohmian mechanics. The article interrogates transnational feminisms as a concept and as a practice. It frames its analysis using contemporary theories of globalization and the older concept of global sisterhood as a backdrop to the concept of transnational feminism. To assess the practical dimension of transnational feminisms, the analysis focuses on women's rights as a human rights movement and the transnationalization of Latin American feminisms. The article suggests that, although transnational feminisms (particularly feminist postcolonial theories) envision themselves in a new frame and (...) see themselves as committed to intersectional analysis and transversal politics, there are important gaps between the intentions (theory, tactics) and outcomes of their theory and practice.
